- The MyLeadSystemPRO™ Contest (“Contest”), which is sponsored by Upward Enterprises, LLC (“MLSP®”) begins March 17, 2010 and ends June 15, 2010.
- The Contest is open to Contestants located in any geographic region in which the Contest fully complies with all applicable laws.
- The Contest is open to any individual (“Contestant”) who is an MLSP® member in good standing during the Contest and whose membership account is paid in full during the Contest. Each Contestant must fully comply with all terms and conditions of the Contest, as well as all terms and conditions applicable to their MLSP® membership.
- MLSP® will identify the winners of the Contest by determining which existing MLSP® member at each of the four levels refers the most new members to MLSP® during the Contest. To count towards the total, each newly referred member must maintain an MLSP® membership in good standing, pay all applicable, full price (not trial offer) membership/subscription fees, and fully comply with all applicable terms and conditions applicable to MLSP® membership. In the event of a tie, the winner will be determined by the greatest number of leads generated.
- MLSP® will award the following prizes
- First Prize: Apple® MacBook® PRO 15.4” 2.53 GHz. Total approximate retail value of this prize package is $2,000 US.
- Second Prize: Apple® iPad™. Total approximate retail value of this prize package is $829 US.
- Third Prize: Flip Ultra® HD Camera. Total approximate retail value of this prize package is $400 US.
- Winners will be announced by June 23rd, 2010. Prizes are non-transferable. A winner may elect to receive cash in lieu of an award in an amount equal to 75% of the prize value posted above, or a prize option of lesser value. Winners are responsible for all applicable taxes. MLSP® reserves the right to substitute an entire prize or any portion of it for a prize of equal or greater value. Although it is difficult to predict accurately, we anticipate that approximately 1,200 members will participate. Last year, 911 members participated in a similar event. All prizes will be awarded, unless not claimed by June 30, 2010, in which case the prize will be forfeited. The award of any prize is subject to MLSP’s receipt of a fully executed AFFIRMATION OF ELIGIBILITY, RELEASE, AND COMPLIANCE STATEMENT (“Affirmation”). MLSP®will judge the contest and its decisions are final in all respects. MLSP® reserves the right to disqualify any Contestant for any reason. Contestants will not be notified if disqualified.
- All federal, state, provincial, local, or other jurisdictional laws and regulations apply. This Contest is void where prohibited or otherwise restricted by law.
- By entering this Contest and/or accepting a prize, the Contestant hereby grants permission to MLSP® or anyone authorized by MLSP® to use statements, quotes, testimonials, photographs, and/or any other material(s) provided by Contestant as part of the Contest, as well as Contestant’s name, photograph, likeness, and, if applicable, the name of Contestant’s company and affiliation, for advertising, and/or promotional purposes without any additional compensation to Contestant unless prohibited by law. BY ACCEPTING DELIVERY OF THE PRIZE, CONTESTANT AGREES THAT THE PRIZE IS AWARDED ON THE CONDITION THAT MLSP® AND ITS AGENTS, REPRESENTATIVES, AND EMPLOYEES WILL HAVE NO LIABILITY WHATSOEVER FOR ANY INJURIES, LOSSEES OR DAMAGES OF ANY KIND RESULTING FROM ACCEPTANCE, POSSESSION OR USE OF THE PRIZE. Contestant agrees to be bound by the Contest rules and the decisions of the judges and to hold MLSP® and its respective members, directors, officers, employees and assigns, harmless against any and all claims and liability arising out of use/redemption of any prize.
- MLSP® is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or in the announcement of the prizes. To the extent permitted by law, these terms shall be interpreted, and this Contest shall be conducted, in accordance with California law, without giving effect to choice of law provisions. All disputes concerning these terms and this Contest shall be adjudicated in the federal or state courts having jurisdiction over San Diego County, California, USA. If any provision in these Contest Rules is held to be illegal or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these rules shall otherwise remain in full force and effect and enforceable to the fullest extent permitted by applicable law.
